Questions and answers
How long can we keep data about former employees?
Only as long as there's a legitimate purpose, such as accounting, limitation periods or possible legal claims. Set a fixed deletion policy and record it.
Can we use AI to answer a subject access request?
Yes, to help gather and word the answer. But it must be complete and correct, so a human has to check it before it goes out.
Can we use old data to rehire people?
That's a new purpose, and if AI assesses the candidates, it's high-risk. Ask the person, and let a human decide.
