Which AI is best for personal data? ChatGPT, Claude, Copilot, Mistral and Gemini compared
Short answer
None of the big AI services is "approved" under GDPR – it is your use that must follow the rules. All five have business plans with a data processing agreement. ChatGPT, Claude, Copilot and Gemini don't train on business data by default; Mistral does in Pro and Team until an administrator turns it off. Only some plans can keep data in the EU: ChatGPT Enterprise, Copilot within the EU Data Boundary, Gemini with Enterprise Plus or Data Regions, and Mistral with servers in the EU. Claude has no EU storage. With GoalCube, the AI only sees pseudonyms, whichever service you use.
The big five side by side
The table comes straight from GoalCube's catalogue of AI providers and is updated whenever the catalogue is.

Checked 9 October 2026. Free and personal plans (ChatGPT Free/Plus, Claude Free/Pro, the Gemini app, Vibe Free) have no data processing agreement and may train on your data. They are not suitable for your company's personal data.
The most important choice isn't the service
Whichever service you use, you decide which data the AI gets. If you only send pseudonyms, the real names never leave the EU – and the question of where the service processes data becomes far less critical. Pseudonymised data is still personal data for you, though, so your agreement and registration must still be in order.
What to do
- Start with what you already have.If you have Microsoft 365, Copilot is often the easiest.
- Require a business plan and a data processing agreement.Without them, personal data should stay well away.
- Check training and EU data.See the table below.
- Keep the names in the EU.With pseudonymisation in the EU, the AI service's location matters less.
What the law says
- Articles 28 and 44–46 GDPR
- Data processing agreements and transfers outside the EU.
Questions and answers
Is Mistral better because it is European?
Mistral has servers in the EU, but some features can send data elsewhere, and Pro and Team train on your data by default. Check the settings – European ownership alone is not enough.
How often do you update the table?
The table comes from GoalCube's provider catalogue, which is checked against the providers' own pages. The date is shown below the table.
What about free plans?
Free and personal plans usually have no data processing agreement and shouldn't be used for personal data in a business.
